Welcome to WunderColor! We are delighted to help you discover the joy of coloring.

These Terms of Service (these "Terms") govern your access to and use of the WunderColor website (www.wundercolor.com), our library of printable images, and our AI generation tools (collectively, the "Services").

Please read these Terms carefully. By creating an account, purchasing a plan, or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

1. Information About Us

The Services are provided by Kalibr Pte. Ltd. ("WunderColor," "we," "us," or "our"), a private limited company registered in Singapore.

2. Eligibility & Account Registration

2.1. Eligibility

To use WunderColor, you must be at least 18 years of age (or the age of legal majority in your jurisdiction). By creating an account, you represent and warrant that you meet this requirement.

2.2. Account Security

To access our library and tools, you must register for an account. You agree to:

  • Provide accurate, current, and complete account information (specifically a valid email address).
  • Maintain the security of your password.
  • Accept responsibility for all activities that occur under your account.

One Account Per Person: Accounts are for individual use only. Sharing login credentials with friends, family outside your household, or other third parties is strictly prohibited and may result in immediate account termination.

3. Subscriptions, Pricing, and Payments

We offer two primary access plans. All prices are in USD.

3.1. Plan Options

  • Lifetime Access ($59 One-Time): includes unlimited access to our pre-made library, all future library additions, unlimited printing, and a one-time allocation of 20 AI Generation Credits. This plan does not expire unless your account is terminated for a violation of these Terms.
  • Monthly Subscription ($19/Month): Includes everything in Lifetime Access plus 40 AI Generation Credits per month. This is a recurring subscription.

3.2. Recurring Billing and Auto-Renewal

If you choose the Monthly Subscription, you authorize us to charge your payment method $19 USD every month on the anniversary of your initial sign-up date. Your subscription will automatically renew until you cancel.

Cancellation: You may cancel your monthly subscription at any time via your account settings. If you cancel, you will continue to have access until the end of your current billing cycle.

3.3. Payment Processing

We use Stripe, Inc. to process payments. By making a purchase, you agree to be bound by Stripe's Services Agreement. We do not store your full credit card information on our servers.

4. Refund Policy

We want you to be happy with your purchase. All plans are covered by our 30-Day Money-Back Guarantee.

If you are not satisfied with WunderColor for any reason, please contact us at chris@wundercolor.com within 30 days of your initial purchase to request a full refund. Refund eligibility is determined at our sole discretion if we detect evidence of fraud or policy abuse (e.g., mass downloading the library before requesting a refund).

5. Intellectual Property & Licenses

This is the most important section of our Terms. Please read carefully. We grant different rights depending on whether you are using our Pre-Made Library or creating your own images via our AI Tool.

5.1. General Ownership

WunderColor (Kalibr Pte. Ltd.) retains all ownership and intellectual property rights to the WunderColor platform, our software, logos, and the pre-made image library.

5.2. License A: Pre-Made Library Images

Applies to the 10,000+ images found in our browsable collections.

We grant you a Personal, Non-Commercial License to these images.

You CAN:

  • Download and print unlimited copies for personal use.
  • Use images for home activities, hobbies, and relaxation.
  • Use images in non-commercial educational settings (e.g., public school classrooms, homeschooling, non-profit daycare).
  • Share physical, printed copies with friends and family for free.

You CANNOT:

  • Resell the digital files in any format (PDF, PNG, SVG).
  • Use for Commercial Purposes: You cannot use these images on products for sale (e.g., T-shirts, mugs, Amazon KDP, Etsy listings).
  • Redistribute Digitally: You cannot upload these files to other websites, file-sharing platforms, or include them in digital bundles.
  • Sub-license: You cannot transfer the rights to use these images to others.

5.3. License B: AI-Generated Images

Applies ONLY to custom images you generate using our AI tool with your own text prompts.

We grant you a Personal Use License to the specific images you generate.

You CAN:

  • Everything allowed in the Personal License above (Section 5.2).
  • Create unlimited custom designs for personal use.
  • Print and share with friends and family.
  • Use in non-commercial educational settings (e.g., classrooms, homeschooling).

You CANNOT:

  • Commercial Use: You cannot sell or commercially distribute AI-generated images.
  • Claim Exclusive Copyright: Your license is non-exclusive.
  • Generate Illegal Content: You cannot use our AI to generate content that violates third-party IP rights (e.g., "Mickey Mouse") or creates illegal, hateful, or harmful imagery.

6. AI Generation Credits

  • Value: 1 Credit = 1 Image Generation.
  • Non-Refundable: Credits have no cash value and constitute a license to use the AI feature.
  • Expiration:
    • Lifetime Plan: 20 credits are allocated once. They do not expire as long as the account is active.
    • Monthly Plan: 40 credits are allocated monthly. Unused credits do not roll over to the next month. If you cancel your subscription, access to unused monthly credits ends when your billing cycle closes.
  • Availability: We strive to ensure our AI tool is available 24/7, but we cannot guarantee uninterrupted uptime or specific generation speeds (~60 seconds is an estimate).

7. Prohibited Conduct

You agree not to misuse the Services. Prohibited conduct includes:

  • Scraping: Using automated scripts or bots to mass-download our library.
  • Account Sharing: Selling or sharing your login credentials.
  • Reverse Engineering: Attempting to continually access or reverse engineer our source code or AI algorithms.
  • Fraud: Using stolen credit cards or manipulating the credit system.
  • Harmful Use: Uploading prompts to the AI generator that are explicit, offensive, defamatory, or promote illegal acts.

8. Disclaimers and Limitation of Liability

8.1. "As Is" Service

The Services, including all images and AI generations, are provided "AS IS" and "AS AVAILABLE." We make no warranties regarding the quality, accuracy, or fitness for a particular purpose of the images. Print quality will vary based on your printer, ink, and paper settings.

8.2. Limitation of Liability

To the maximum extent permitted by law, Kalibr Pte. Ltd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

Cap on Liability: In no event shall our aggregate liability to you exceed the total amount you paid to us in the twelve (12) months prior to the event giving rise to the claim.

8.3. AI Disclaimer

AI-generated content involves probability and automation. We do not guarantee that AI generations will be error-free or exactly match your prompt. We are not responsible for similarities between AI-generated content and other third-party works.

9. Indemnification

You agree to indemnify and hold harmless Kalibr Pte. Ltd. and its officers, directors, and employees from any claims, damages, liabilities, and expenses (including legal fees) arising out of your use of the Services, your violation of these Terms, or your violation of the rights of a third party (including intellectual property rights).

10. Termination

  • By You: You may stop using the Services at any time.
  • By Us: We reserve the right to suspend or terminate your account immediately, without notice, if you violate these Terms, particularly regarding Commercial Use violations of our pre-made library or Account Sharing.
  • Effect of Termination: Upon termination for violation of Terms, your right to access the library and use remaining credits ceases immediately.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Singapore, without regard to its conflict of law provisions.

Any dispute arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall be referred to and finally resolved by arbitration in Singapore.

12. Changes to These Terms

We may modify these Terms at any time. If we make material changes, we will notify you via the email address associated with your account. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
